Foreign founders can create a company in France

France allows foreign nationals to create companies, including founders who do not live in France. The important distinction is between creating or owning the company and having the right to live and work in France. A founder who plans to move to France and actively carry out the business may need an immigration or residence route that authorises that activity.

Start with the business structure, not the registration form

The formation process should begin with the ownership, management and operating model. SAS and SASU are common structures for international founders because their governance can be flexible, while SARL and EURL remain relevant for other ownership and management situations. The right choice depends on the actual project rather than a generic preference.

Before filing, define the shareholders, legal representative, activity, company name, registered office and the main corporate rules. If the activity is regulated, additional evidence or authorisation can be required.

Arrange the French registered office and capital steps

A French company needs a registered office address. This can come from eligible premises or a commercial domiciliation arrangement. The address becomes part of the corporate records and registration file. For company forms that require a capital deposit, the capital step also needs to be completed with the appropriate supporting evidence before the registration file is finalised.

Prepare the registration file for the Guichet unique

Company creation formalities are filed online through the French business formalities system. Depending on the structure, the file can include signed articles, management appointments, registered-office evidence, capital evidence, legal-publication evidence and identity or corporate documents for the participants.

Once the company is registered, the work is not necessarily finished. Accounting, VAT, payroll, customs or employer registrations depend on what the company will actually do.

Do not confuse company ownership with residence rights

A non-EU founder may be able to own or form a French company without becoming a French resident. If the same person also plans to relocate and run the activity from France, the residence route must be checked separately. The business project, economic viability and the applicant’s situation can affect the relevant immigration path.

For many international founders, the efficient sequence is to coordinate the legal entity, registered office, capital and registration file first, then connect the company to French accounting and any payroll or mobility work that actually applies.
